Leaked Ofosu Ampofo tape saga: Kwaku Boahen loses round 1 in court

An Accra High Court has dismissed an application filed by Deputy NDC Director of communication Kwaku Boahen in which he sought the court to strike out a charge of conspiracy to cause harm levelled against him by the Attorney General.

Justice Samuel Asiedu in his ruling held that the application was without merit as it invited the court to assess the case even before state prosecutors could call their witnesses.

 

NDC National Chairman Samuel Ofosu Ampofo and Mr Boahen are standing trial over the leaking of audio state prosecutors say is a plot by the NDC leader to commit various crimes.

Multimedia reporter Joseph Ackah-Blay who was in court has reported that the lead Counsel for Kwaku Boahen, Dr Aziz Bamba, argued that documents filed by the AG failed to satisfy the elements required to sustain a charge of conspiracy to cause harm.

Chief State Attorney Asiamah Sampong, however, opposed the application, arguing that it was premature as the state prosecutors intended to, in the course of the trial, prove the case filed with credible evidence.

He added that the court had earlier ruled on a similar application filed by lawyers for the NDC chairman.

Justice Asiedu dismissed the application, directing that state prosecutors call their first witness to testify.

Lead Counsel for Mr Ampofo, Tony Lithur, also informed the court that an application for stay of proceedings had been filed.

Justice Asiedu said he was not aware of the application and asked that the case continued.

Chief State Attorney, Asiamah Sampong, however, informed the court that the state’s first witness was not available.

The case has been adjourned to July 23, 2019.
