President Addo Dankwa Akufo-Addo has said that the situation where judges prefer judgement on the basis of the decisions from lower courts and cite them as law is not acceptable.

He explains that the Supreme Court of Ghana is not bound to follow decisions of any other court including it’s own but has all the powers, authority and jurisdiction vested in any established by the Constitution or any other law, according to Article 129 of the 1992 Constitution.

President Akufo-Addo, therefore, says judges, especially Supreme Court Judges must be learned, know their cases and ensure that decisions and judgments are properly motivated in order to contribute to the orderly development of the country.

The President stated these when he sworn-in Justice Clemence Hoenyenuga at a short ceremony at the Jubilee House.

President Akufo-Addo noted that Justice Hoenyenuga has had somewhat difficult few weeks but he comported himself in a dignified manner.

He, therefore, urged the new Supreme Court Judge to overlook these events and ensure the strict application of the laws without fear or favour as well as dispense justice in accordance with his conscience and the rule of law.

President Akufo-Addo added that with over 39 years experience, Justice Hoenyenuga will do justice to all manner of persons as prescribed by the Constitution.

Justice Hoenyenuga pledged to uphold the faith reposed in him, to the best of his ability, to ensure the 1992 Constitution is upheld and for that matter the rule of law.
