Human Rights Court restrains Special Prosecutor from arresting Charles Bissue

Lawyer for Charles Bissue, Nana Agyei Baffour moved the ex-parte application in court today 15 June to stop the OSP from pursuing his client

Human Rights Court presided over Justice Nicholas Abodakpi, has granted an ex-parte (without notice to the other party) application by lawyers of Charles Bissue, restraining the Office of the Special Prosecutor (OSP) from arresting the former Presidential Staffer.

Lawyer for Charles Bissue, Nana Agyei Baffour made the ex-parte application in court today 15 June 2023, to stop the Special Prosecutor from pursuing his client until the final determining of three cases his client has filed, first, seeking to stop the OSP from investigating him after the Police did same and cleared him of any wrong doing.

Mr Bissue also has a pending application at the High Court for the enforcement of his fundamental human rights and another for an order of interlocutory injunction to restrain the OSP from enforcing the arrest warrant issued by the Kaneshie district court pending the final determination of the substantive suit he has filed in court.

The Interim Injunction granted by the Court for a period of ten (10) days essentially prevents the OSP from executing the arrest warrant it purports to have procured with regard to Charles Bissue.

 

 

It also stops the OSP from applying for further arrest warrants pending the determination of the substantive matter Charles Bissue has instituted in the court and from publishing notices purporting the applicant to be wanted pending the determination of the substantive matter.

The case has subsequently been adjourned to Thursday 22 June 2023 by Justice Nicholas Abodakpi’s court.

OSP wanted notice

The Office of the Special Prosecutor (OSP) on Tuesday 13 June 2023, declared the former secretary of the Inter-Ministerial Committee on Illegal Mining (IMCIM), Charles Cromwell Nanabayin Onuawonto Bissue wanted.

The move came days after the Office of the Special Prosecutor secured an order from the court to arrest Bissue.
In a tweet on Tuesday (13 June), the OSP said: “Charles Cromwell Nanabayin Onuawonto Bissue is wanted by the #OSP on Corruption and corruption-related offences regarding the activities and expenditure of the dissolved Inter-Ministerial Committee on Illegal Mining (IMCIM)“.
